Terms of Service
These terms govern access to and use of Agata. By creating an account or using the service, you agree to these terms and the Privacy Policy.1. Service and acceptance
Agata provides workspaces with organisation, collaboration, and AI-assisted tools. Some features may be in beta, may change, or may not be available on every plan.
You must be at least 18 and legally capable of entering a contract. If you use Agata for an organisation, you represent that you can bind it to these terms.
2. Account and security
You must provide accurate information, keep credentials secure, and notify us if you detect unauthorised access. You are responsible for actions taken through your account unless they result from a failure attributable to Agata.
Workspace owners and administrators control members, permissions, and certain workspace settings. Customer organisations are responsible for authorising the people they invite.
3. Your content
You retain rights in the content you enter. You grant Agata a limited, worldwide, non-exclusive licence to host, copy, transmit, and transform it only as needed to provide, secure, and maintain the service.
You must have the rights and legal basis required to add another person's data or content. Do not upload unlawful, harmful, misleading, infringing, or privacy-violating content.
4. Plans, payments, and credits
Each workspace has its own plan, member capacity, and AI credit balance. Each accepted Agent message consumes one credit regardless of the model or tools used. Monthly credits expire at the end of the period and do not roll over.
Plans and recurring add-ons are charged through Stripe. Before purchase, the checkout will show the price, interval, known taxes, and when the change applies. Increases may apply immediately after payment; decreases may be scheduled for renewal.
Unless stated otherwise, subscriptions renew automatically until cancelled. Cancellation stops future renewals and normally preserves access until the end of the paid period.
5. Consumers and withdrawal
If you contract as a consumer, you retain the mandatory rights of your country. Before a digital service starts immediately during a withdrawal period, we may ask for your express consent and acknowledgement of the applicable legal consequences.
Nothing in these terms limits rights that cannot legally be excluded. Terms shown at checkout prevail for that purchase where they are more favourable.
6. Acceptable use
You may not use Agata to break the law or third-party rights, distribute malware, gain unauthorised access, evade limits, overload the service, conduct unlawful reverse engineering, or automate abusive activity.
We may limit or suspend activity where necessary to protect people, data, or infrastructure, investigate abuse, or comply with law. Where reasonable, we will provide notice and an opportunity to remedy the issue.
7. AI and sensitive features
AI results may contain errors, omissions, or unexpected content. You must review them before making important decisions or taking material actions. Results are not guaranteed to be unique or eligible for exclusive rights.
Finance, health, and nutrition features support personal organisation and do not replace financial, medical, nutritional, legal, or other professional advice. Seek qualified assistance for high-risk decisions.
8. Availability and changes
Agata aims to keep the service available, but maintenance, provider failures, or incidents may occur. No guaranteed service level applies unless specifically agreed in writing.
We may change features or these terms for legal, technical, or product reasons. Where a material change negatively affects an active subscription, reasonable advance notice will be provided where possible.
9. Termination and data
You may stop using Agata and request account closure. We may end access for material breach, security risk, non-payment, or legal requirement.
You should export any content you need before closure. The deletion and retention periods in the Privacy Policy apply after termination.
10. Liability and governing law
Each party is responsible for loss legally attributable to it. To the fullest extent permitted, Agata is not liable for indirect loss, lost opportunity, or decisions based solely on AI results. This limitation does not apply where prohibited by law.
These terms are governed by Spanish law. Consumers may use the courts and mechanisms granted by the mandatory law of their residence. For business relationships, the parties will first try to resolve disputes in good faith.
